Information We Collect

1.Subscriber Information.

Subscribers are asked to provide certain personal information when they sign up for TalcoSoft services including name, postal address, email address, telephone number, and billing information (such as a credit card number). In addition, to register a domain name, Subscribers are asked to provide this information for the registrant, administrative contact, technical contact and billing contact of the domain name (collectively, "Domain Name Registration Information"), for submission to the appropriate domain registry or registration database. Subscribers may also be asked to complete an online form that collects information about demographics, product usage and preferences, along with other information that will help us improve our products and services.

2.Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, subscribe to the newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

3.Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

4.Business information collection and use by TalcoSoft

We collect the Business Information necessary to enable us to respond to your requests for our products and services and to send you information regarding our products and services from time to time. Since most of the users of our products and Sites are doing so in their capacity as employees or companies, most Business Information we collect will be in that capacity (rather than information about you individually, such as your personal tastes, etc.). For these purposes, we have defined "Business Information" as any information that identifies or may identify a company or an individual contact at a company or that allows others to contact a company or an individual contact at a company. When you visit the Sites, you may be asked to submit information such as email address, company name, address, phone number, your product version, and/or areas of interest. We may also ask you where you heard about our company or products, or for other information that will help us understand more about your needs or help us process your requests for information. In addition, we collect credit card and related payment information when you order products, services, or support plans online. Our information collection and use practices are described in more detail below:

  • Product registration. You may be asked, on behalf of your company, to complete registration/activation form(s) on the Sites or from within the products, with contact information for use by us in accordance with this policy. Registration or activation information may include the name of your company, contact information, product information, customer ID, network and operating system, and other relevant information.
  • Customer profile. We also collect Business Information when you create a customer profile or Passport account on some of the Sites, which is required in order to access certain areas of the Sites, purchase support plans and products, to obtain software downloads and certain online support services, and to request information from us about our products and services. This information includes company name and contact information and other information about your company (for example, size, revenue, and number of employees), the products you may have licensed, and other non-TalcoSoft products you may currently use. We use this information in accordance with this policy to identify you, process your requests, and administer your TalcoSoft account(s).
  • Support. We offer certain limited online support services at the Sites. If you access online support on any of the Sites, you may be asked for information such as customer ID, product name, product version, and other information to help us determine what the technical issues are and how best to help you resolve them. In addition, certain products allow you to submit support-related questions directly from the product. If you access online support services from a product, information about your network, operating system, printer, data and program path, product type, version, customer ID, the product's technical support information sheet, product serial number, and other similar information will be automatically pre-populated for submission to our customer support representatives to assist them in answering your questions.
  • Newsletters. When you subscribe or sign up to receive newsletters published or offered via the Sites, we will ask you for information necessary to enable us to process your request and to send you information regarding our products and services.
  • Cookies. Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.
  • Product-related information collection. We collect certain additional information in connection with your use of our services or desktop products with online features. For instance:
    • Product updates. Some products provide you with the ability to download and register product and/or tax updates as they become available. During the download and registration process, we collect Business Information, including customer ID number and product version, type, and serial number, in order to authorize your access and provide you with the appropriate update, and to update our records as to the product and products updates you have downloaded or installed.
    • Account set-up and access. Upon subscribing to our services, we collect Business Information which may include information such as product serial number, customer ID, and your customer profile information, in order to identify you and authorize your access and use of the services and provide you with your relevant account information. Certain products provide you with the ability to access your account in order to obtain information such as your support plan status, service subscriptions, registrations, and order history.
    • Online product/account application. Certain products and services are subject to an application and enrollment process, which may be completed on paper or online. Information requested may include federal ID numbers, bank account, payroll, credit card, and contact information. This information is used to process your enrollment request and, if approved, to set up and administer your account.
    • Web-based services. In connection with certain of our web-based services we collect certain additional information, including IP address, browser, connection speed, domain, referring URL, and other environment-related information to enable us to provide a secure environment for the use of the services, to pre-populate forms, and calculate aggregate statistical information about the customers using these services.
    • TalcoSoft products and services. In addition to the uses set forth above, we may use your Business Information to: 1) inform you of product upgrades and updates and subscription renewals; 2) inform you of tax, regulatory, and other compliance issues with your software product or service; 3) notify you of products and services that we think may be of interest to you; 4) offer you discounts or other promotions with respect to Sage products and services that we think may interest you; and 5) contact you for survey purposes to determine how we can better service you or provide better products to meet your needs.
    • Other TalcoSoft company products and services. Your Business Information may be provided to one or more other TalcoSoft Companies to enable them to market products and services to you. In that case, the use of your Business Information would be governed by that TalcoSoft Company's privacy policy.

    • Third-party products. We may also use your Business Information to inform you of special discounts or offers from other companies we have carefully selected and whose products and services may be of interest to you.

5.Collection by Linked Websites.

TalcoSoft may provide links to some third party websites as a convenience. Please exercise care when visiting linked websites. The linked websites have separate and independent privacy statements, notices and terms of use which we recommend you read carefully. When you visit or make purchases through these third party sites, you may be asked to provide personal information, such as your name, address, email address, phone number, and credit/debit card information. Please note that in such cases, you are providing information to a third party and TalcoSoft has no control over such third party's use of any information you provide and, therefore, TalcoSoft has no responsibility or liability for the manner in which the third party that operates a linked website may collect, use, disclose, secure or otherwise treat your personal information. Except as provided herein, TalcoSoft will not provide any of your personal information to any third parties without your consent.

Sharing of Information

With the exception of other members of the Endurance corporate family and trusted business partners who work with or on behalf of TalcoSoft, and are subject to specific confidentiality agreements, TalcoSoft will not provide or sell to any third party your personal information and will keep all Subscriber information confidential, subject to the following:

Upon registration for TalcoSoft services, certain Subscriber information may be transferred to trusted affiliated or unaffiliated third parties that help TalcoSoft provide certain services or that provide certain services on TalcoSoft 's behalf. For example, Subscriber information may be transferred to TalcoSoft 's affiliated registrar, FastDomain (WHOIS Domain Name Registration Information), or to unaffiliated third parties that help TalcoSoft provide email services or SSL certifications.

3.Co-marketing Activities.

Some services are offered or promoted in conjunction with a TalcoSoft partner or sponsor. For example, TalcoSoft may partner with other corporate affiliates of Endurance or with trusted non-affiliated partners for co-promotions of a particular product or service. TalcoSoft may share certain Subscriber contact information but no billing information with TalcoSoft 's partner or sponsor in order to provide the relevant services or to run the promotion. If TalcoSoft shares Subscriber information with partners and sponsors, TalcoSoft requires that they maintain the Subscriber information in confidence, and use the information solely for purposes of providing the services or carrying out the agreed upon promotion.

4.Online Advertisements.

TalcoSoft does not share personally identifiable information about individual users with advertisers. TalcoSoft may display online advertisements and share aggregated and non-identifying information about Subscribers collected through the registration process or through online surveys and promotions with certain advertisers. This aggregated and non-identifying information may be used to deliver tailored advertisements. For example, an advertiser may tell TalcoSoft the audience it wants to reach (e.g., males between 25 and 55 years of age) and provide TalcoSoft with an advertisement tailored to that audience. Based upon the aggregated and non-identifying information collected by TalcoSoft, TalcoSoft may then display the advertisement to the intended audience.

5.Customer Surveys.

In addition to sharing survey information with service providers confidentially as described above, TalcoSoft may share aggregated, non-personally identifying information obtained from customer surveys within the Endurance corporate family or with third parties.

6.Law Enforcement.

TalcoSoft will respond to subpoenas, court orders, or other legal processes, and will utilize Subscriber information as necessary to establish or exercise TalcoSoft 's legal rights or defend against legal claims. Additionally, TalcoSoft will share information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations or suspected violations of TalcoSoft 's Terms of Service, or as otherwise required by law.

7.Domain Registration.

In certain jurisdictions or pursuant to the rules of the Internet Corporation for Assigned Names and Numbers ("ICANN") or certain registries, Domain Name Registration Information has to be made available and accessible to the public through a "WHOIS" search. The WHOIS database is a publicly accessible database that lists the Domain Name Registration Information for a particular domain name, the name server(s) to which the domain name points, and the domain name's creation and expiration date. The Domain Name Registration Information you provide is hosted by TalcoSoft or a third party service provider and is made available to the public through WHOIS searches. TalcoSoft may deposit your Domain Name Registration Information with a third-party escrow provider to comply with ICANN requirements. At times, Subscribers may receive solicitations that result from searches of the publicly available WHOIS database by other companies or individuals. Any such solicitations or SPAM do not come from TalcoSoft and TalcoSoft does not control the use of WHOIS information by third parties.

8.Domain Privacy.

When TalcoSoft is threatened with suit by a third party, or any other legal action is brought to TalcoSoft 's attention involving TalcoSoft based on the anonymity of a domain name, TalcoSoft may seek assurance from you, the customer, concerning your promise to indemnify TalcoSoft and written confirmation that you have contacted the complainant and made your contact information available to the complainant. Failure to promptly provide these assurances may be considered by TalcoSoft to be a breach of your agreement with TalcoSoft and may result in deactivation of your domain name and disclosure of your contact information so that any allegations of infringement or other wrongdoing may be directly resolved between you and the complainant.

Changes to this privacy policy

TalcoSoft has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

If you provide any feedback on any of our products or services to us, we may use such feedback for any purpose, provided we will not associate such feedback with your Personal Information.
